Article 2 — Scope & Acceptance
These General Conditions of Sale (hereinafter "GCS") govern all sales of products offered by BijouxLune SAS (hereinafter "the Seller") through the website bijouxlune.com to any natural person acting for purposes outside their commercial, industrial, artisanal, or independent professional activity (hereinafter "the Customer").
By placing an order, the Customer acknowledges having read, understood, and accepted these GCS without reservation. These GCS prevail over any other conditions, except with the prior, express, and written consent of the Seller.
The Seller reserves the right to modify these GCS at any time. The applicable conditions are those in force on the date the order is placed.
Article 3 — Products
The products offered for sale are described with the greatest accuracy possible. Photographs are for illustrative purposes and do not constitute a contractual element. In the event of a discrepancy between the photograph and the product description, the description shall prevail.
All products are certified Sterling Silver 925 and feature genuine gemstones, unless otherwise stated. Certificates of authenticity are available upon request.
Products are offered subject to availability. In the event of unavailability after an order has been placed, the Customer will be informed without delay and offered a full refund within 14 days.
Article 4 — Prices
Prices are indicated in Euros (€) and include all taxes (TTC — Toutes Taxes Comprises). Shipping costs are indicated separately before the order is confirmed.
The Seller reserves the right to modify prices at any time. The price applicable to the order is the price in force at the time of order validation.
Article 5 — Orders
The order process comprises the following steps: (1) product selection and addition to basket; (2) review of basket contents; (3) entry of delivery information; (4) selection of payment method; (5) review and acceptance of GCS; (6) order confirmation and payment.
The sale is concluded upon confirmation of payment. An order confirmation email, summarising the order details and these GCS, will be sent to the Customer.
The Seller reserves the right to cancel or refuse any order in the event of an existing dispute, incomplete information, abnormal order patterns, or suspected fraud.
Article 6 — Payment
Payment is due in full at the time of order. Accepted payment methods include Visa, Mastercard, American Express, PayPal, Klarna, and Apple Pay.
All transactions are secured via SSL/TLS encryption and processed by PCI-DSS compliant payment providers. The Seller does not store payment card data on its servers.
Article 7 — Delivery
Products are delivered to the address provided by the Customer during the order process. The Seller delivers within France and across the European Union.
Indicative delivery times: France: 3–5 business days · EU: 5–10 business days. These timeframes begin from the date of dispatch confirmation. The Seller shall not be liable for delays caused by the carrier or events beyond its control (force majeure).
In the event of non-delivery within 30 days of the order date, the Customer may cancel the order and obtain a full refund in accordance with Article L216-2 of the French Consumer Code.
The Customer must inspect the parcel upon delivery. Any damage or non-conformity must be reported within 48 hours of receipt.
Article 8 — Right of Withdrawal
In accordance with Articles L221-18 to L221-28 of the French Consumer Code and EU Directive 2011/83/EU, the Customer has the right to withdraw from the purchase within fourteen (14) calendar days from the date of receipt of the goods, without providing any reason and without incurring any penalty.
To exercise this right, the Customer must notify the Seller of their decision by email at contact@bijouxlune.com or by post, using the model withdrawal form or any other unambiguous declaration.
Products must be returned in their original condition, unworn, with all tags and packaging intact, within 14 days of the withdrawal notification. Return shipping costs are borne by the Customer unless the item is defective.
The Seller shall reimburse the Customer within 14 days of receiving the returned goods, using the same payment method as the original transaction.
Exclusions: Personalised, engraved, or made-to-order items are excluded from the right of withdrawal in accordance with Article L221-28 of the French Consumer Code, unless defective.
Article 9 — Warranty
Legal Warranty of Conformity: In accordance with Articles L217-4 to L217-14 of the French Consumer Code, the Customer benefits from the legal warranty of conformity for a period of two (2) years from the date of delivery. The Customer is not required to prove the defect during this period.
Warranty Against Hidden Defects: In accordance with Articles 1641 to 1649 of the French Civil Code, the Customer may seek remedy for hidden defects rendering the product unfit for its intended use. Action must be initiated within two (2) years of discovering the defect.
Commercial Warranty: BijouxLune additionally offers a 2-year commercial warranty covering manufacturing defects. This warranty does not cover damage resulting from misuse, negligence, normal wear and tear, or improper care.
Article 10 — Liability
The Seller shall not be held liable for damages resulting from misuse, negligence, or failure to follow care instructions provided with the products.
The Seller's total liability shall not exceed the purchase price of the product(s) in question.
The Seller shall not be liable for events of force majeure as defined by Article 1218 of the French Civil Code.
Article 11 — Intellectual Property
All content on the bijouxlune.com website (text, images, logos, designs, videos, graphics) is the exclusive property of BijouxLune SAS and is protected by French and international intellectual property law. Any reproduction, distribution, modification, or use without prior written authorisation is strictly prohibited.
Article 12 — Personal Data
The Seller collects and processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and French Law No. 78-17 of 6 January 1978 (Informatique et Libertés). For complete information on data processing, please refer to our Privacy Policy.
Article 13 — Mediation & Disputes
In the event of a dispute, the Customer is invited to first contact the Seller to seek an amicable resolution.
In accordance with Articles L611-1 to L616-3 of the French Consumer Code, the Customer may refer the matter to a consumer mediator free of charge. The appointed mediator: [Nom du médiateur] — [Coordonnées du médiateur].

In the absence of an amicable resolution, disputes shall be subject to the exclusive jurisdiction of the competent French courts, in accordance with applicable law.
Article 14 — Applicable Law
These GCS are governed by and construed in accordance with French law. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
